DIRECTIVE NO. 79

SUBJECT: Rules and Regulations – Citizens Duty to Evacuate.

Whenever the Governor, the State Director-Office of Emergency Management, County Emergency Management Coordinator, or Municipal Emergency Management Coordinator shall declare an emergency is defined in N.J.S.A. App. A:9-33, et seq. And whenever the aforementioned parties shall determine that it is in the interest of the health, welfare, and safety of the public to evacuate an area, each individual within the disaster area, as declared by the aforesaid parties, shall evacuate said area in accordance with the directives of Emergency Management personnel.

  1. Any person who refuses to evacuate an area in accordance with the mandates of a legally declared emergency order may be charged with a violation of Appendix A: 9-49, and removed from the area, except where Section 2 of this Directive would be applicable.
  2. If a person (s) refusal to evacuate a home or other dwelling to which he or she has a legal right of ownership or occupancy significantly obstructs or interferes with the overall emergency operation in such area, in accordance with the mandates of a legally declared emergency order, he or she may be charged with a violation of Appendix A: 9-49 and removed from the area.

Directive No. 79 dated November 19, 1986 is hereby revised.
