Citizen Complaint Information

The members of the Morris County Prosecutor’s Office are committed to providing law enforcement services that are fair, effective, and impartially applied. It is in the best interests of everyone that your complaint about the performance of an individual member is resolved fairly and promptly, therefore this Office has formally established procedures for investigating your complaint. Furthermore, these procedures are designed to ensure fairness and protect the rights of both civilians and members of the Morris County Prosecutor’s Office. The following information serves as a general guide to understanding the internal affairs process:

  1. Complaints made against our employees are taken very seriously and will be thoroughly investigated.  Therefore, it is very important that the information you provide is as complete as possible, accurate to the best of your knowledge, and completely truthful, so that the matter can be promptly investigated and resolved.          

  2. Reports or Complaints of member misconduct must be accepted from any person, including anonymous sources, at any time.

  3. Complaints shall be accepted regardless of age, race, ethnicity, religion, gender, sexual orientation, disability, or immigration status of the complaining party.

  4. Your complaint will be sent to a superior officer or a specially trained internal affairs investigator in our Professional Standards Unit, who will conduct a thorough and objective investigation.

  5. You may be asked to assist in the investigation by giving a detailed statement about what happened, or by providing other important information or documents.

  6. All complaints against members are thoroughly investigated. You will be kept informed of the status of the investigation and its ultimate outcome, if requested, and advised of the ultimate finding that consists of one of the following:

  • Not Sustained: The investigation failed to disclose sufficient evidence to clearly prove or disprove the allegation.
  • Sustained: A preponderance of the evidence shows a member violated any law; regulation; directive, guideline, policy, or procedure issued by the Attorney General or County Prosecutor; office protocol; standing operating procedure; rule; or training.
  • Exonerated: A preponderance of the evidence shows the alleged conduct did occur, but did not violate any law; regulation; directive, guideline, policy, or procedure issued by the Attorney General or County Prosecutor; office protocol; standing operating procedure; rule; or training.
  • Unfounded: A preponderance of the evidence shows that the alleged misconduct did not occur. If our investigation results in a member being charged with a violation of office rules, you may be asked to testify in a departmental hearing.

7. If our investigation indicates that the complaint is unfounded or that the member acted properly, the matter will be closed.

8. If our investigation results in a member being charged with a violation of office rules, you may be asked to testify in a departmental hearing.

9. If our investigation indicates that a crime might have been committed, you may be asked to testify in court.

10. Internal affairs investigations are confidential and all disciplinary hearings shall be closed to the public unless the involved member requests an open hearing.

11. You may contact the Professional Standards Unit at 973-285-6200, on Mondays through Fridays between the hours of 8:30 am and 4:30 pm, with any additional information or any questions about the case.
