DOVER MAN INDICTED FOR VEHICULAR HOMICIDE
Acting Morris County Prosecutor Fredric M. Knapp and Parsippany-Troy Hills Police Chief Paul Philipps announce Fabio Aristizabal, 59 years old, of Dover, New Jersey, was indicted today after an investigation revealed that he allegedly struck a pedestrian while driving a motor vehicle under the influence of alcohol.
At approximately 1:54 a.m. on December 22, 2012, Parsippany-Troy Hills Police responded to Route 10 West in the area of the Pelican Ski Shop. A pedestrian had been struck by a motor vehicle allegedly driven by the defendant. After striking the victim, Richard Oberst, date of birth March 1, 1948, the defendant continued driving a short distance and then returned to the scene. A passing motorist placed a 911 call to the police.
Upon the arrival of the police, the defendant consented to provide a blood sample which later returned a blood alcohol content of .07%. A subsequent expert report was performed including an extrapolation of the blood alcohol content reading and it was concluded that the defendant's blood alcohol content was in the range of .09-.14% at the time of the crash. This is above the legal limit which is a blood alcohol content below .08%.
Defendant was indicted on Second Degree Vehicular Homicide.
The defendant turned himself into the Court. The Honorable Salem Vincent Ahto, J.S.C., (Retired, Temporarily Assigned on Recall) set bail at $75,000.00 cash, bond or property with no 10% option. The defendant was also ordered to surrender his passport.
The arraignment is scheduled for September 3, 2013 before the Honorable Stuart A. Minkowitz, P.J.Cr.

The charges and allegations contained in the indictment are merely accusations, and the defendant is considered innocent unless and until proven guilty.
