Victory Gardens Man Charged With Possession With Intent To Distribute Controlled Dangerous Substances

Acting Morris County Prosecutor Fredric M. Knapp announces today that Felix Garcia of Victory Gardens, New Jersey, has been charged with one count of Second Degree Possession with Intent to Distribute Heroin; one count of Second Degree Possession With Intent to Distribute Cocaine; one count of Third Degree Possession of a Controlled Dangerous Substance (Heroin); and one count of Third Degree Possession of a Controlled Dangerous Substance (Cocaine).
An investigation by the United States Immigration and Customs Enforcement, the principal investigative arm of the United States Department of Homeland Security, and the United States Postal Inspection Service detected a suspicious package in Miami which was sent from the Dominican Republic to a postal address in Victory Gardens, New Jersey. With the assistance of these two agencies, the Morris County Prosecutor's Office Narcotics Task Force intercepted the package, obtained and executed a search warrant on the package and determined that it contained approximately 100 grams of cocaine.
A subsequent search warrant was obtained for the defendant's residence on Washington Avenue in Victory Gardens. Undercover law enforcement officers delivered the package to the residence, where a person identified as Felix Garcia allegedly accepted delivery and subsequently opened the package inside the home. Moments later the search warrant was executed on the home yielding the contents of the package which was 100 grams of cocaine concealed in chocolate candy. In addition thereto, 28 bricks of heroin, which is the equivalent of 1400 individual doses of heroin, $660 in cash and a false identification card bearing the name of the addressee on the package believed to be an alias of Felix Garcia were recovered at the home. The total estimated street value of the controlled dangerous substances is approximately $44,000.
The defendant was arrested on October 10, 2013.
The Honorable Gerald Smith, J.M.C. set bail at $350,000 cash only. The defendant was unable to post bail and was remanded to the Morris County Correctional Facility.
The investigation is active and ongoing. No other information is being released at this time.

A criminal complaint is merely an accusation. Despite this accusation, the defendant is presumed innocent unless and until he or she has been proven guilty beyond a reasonable doubt in a court of law.
