Civil Unrest and the Law

The First Amendment rights to free speech and peaceful assembly are foundational to our democracy. However, these rights are not absolute and balancing them with the need to maintain public order presents complex challenges for law enforcement. This course aims to provide officers with both legal and historical perspectives/context to navigate the fast-paced and often nuanced situations that arise during public demonstrations. Participants will receive training on use of force in civil disturbance situations, as well as a review of relevant Attorney General guidelines. Topics covered include an overview of applicable case law, time, place, and manner restrictions, review of applicable criminal offenses, and the rights of the press and of individuals to record during protests. This course is intended for all law enforcement personnel, from patrol officers to supervisory staff.

Speaker Bio:

            Justin Tellone is a 12-year veteran Assistant Prosecutor from the Morris County Prosecutor’s office. He is the lead instructor for use of force training in his office.
